Section 6.1 - Insurance

INSURANCE OVERVIEW

The AS purchases insurance or has established self-insured programs for its property and liability risks, as specific circumstances require. This policy has been approved by Associated Students Council and complies with insurance practices established by the CSU. The AS can be exposed to risk when using contractors, consultants, service providers, and/or vendors to provide goods or services or when outside organizations and individuals use AS premises and/or facilities. The AS requires contractors, consultants, service providers, and/or vendors doing business with the AS, as well as outside organizations and individuals using AS premises and/or facilities, to maintain liability insurance and other insurance as necessary to reasonably protect the AS financial interests, and in amounts deemed adequate by the AS

The AS may also be exposed to risk when divisions fail to follow AS policies and procedures with respect to entering into contracts, leases, or other types of agreements, on behalf of the AS Divisions do not have the authority to bind the AS to a contract, lease, or agreement, etc. All contract documents, to which the AS is a party, are executed by either the AS Executive or Associate Director after approval by the originating AS division and the AS accounting department.

Insurance Procurement

The AS Associate Executive Director has been delegated the responsibility for procurement of insurance through CSURMA (California State University Risk Management Authority) by the Associated Students Council.

TYPES OF COVERAGES

Property Coverage

The AS purchases commercial insurance on its property when required by specific circumstances, including contractual obligations. Commercial property insurance is provided under a master property policy subject to a deductible. The deductible is charged to the division sustaining the loss. Insured values are reviewed annually with the insurance carrier, and the buildings are insured on a replacement cost basis subject to the terms, conditions, and exclusions of the policy. The AS places its insurance coverage with commercial insurers who have strong financial ratings given by one or more financial rating companies such as A.M. Best Company, Standard and Poor's, or Moody's Investor Service. The AS carries commercial property insurance under the following circumstances:

Personal Property

Individuals who choose to bring personal property onto AS premises should contact their insurance agent to be certain their property is properly insured. The AS assumes no responsibility for any loss, theft, or damage to an individual's personal property brought onto AS premises, or AS-leased premises, even if the property is brought to the AS to be used in connection with their work. The AS carries no insurance to cover any of these losses.

Procedure to Obtain Property Insurance

All AS bond-funded real property is covered through the SDSU CSURMA Policy. All other AS real property is covered through the AS-CSURMA Policy. Values for contents insurance are derived from the AS fixed assets report.

Liability Coverage

The AS is covered for liability through the AS-CSURMA Auxiliary Group Purchase Program.. Coverage limits are in accordance with CSU policy and are determined by the CSURMA-AGPIP Memorandum of Coverage and related documents. The policy may occasionally contain exclusions that must be covered by commercial insurance. The AS Associate Director makes determination of those coverage needs.

The AS may also be exposed to risk when units fail to follow AS policies and procedures with respect to entering into contracts, leases, or other types of agreements on behalf of the AS Divisions do not have the authority to bind the AS to a contract, lease, or other type of agreement. Auto Liability

The AS is covered for auto liability through the AS-CSURMA Auxiliary Group Purchase Program.

Employees who frequently drive an AS-owned vehicle may wish to verify with their automobile insurance agent that their personal auto liability coverage is available as the CSURMA Policy does not cover liability for personal autos.

Crime Insurance (Employee Dishonesty)

The AS purchases commercial insurance to protect against financial loss resulting from employee dishonesty. This insurance is sometimes referred to as crime insurance. The AS retains a high deductible per loss. The deductible is charged to the division sustaining the loss.

Other Coverage

Various group insurance plans, as approved by The Associated Students Council are available to staff. The plans also include other coverage as required by law.

Full time Staff Group Insurance

The AS provides several group policies for full time staff who qualify, such as:

Workers' Compensation

As required by law, the AS provides Workers' Compensation coverage. For information, or to file a claim, contact the Business Services Manager.

Unemployment Compensation

As provided by State of California, employees are eligible for unemployment compensation. The AS is self-insured for unemployment coverage, meaning that we reimburse the State of California for any payments made to our former employees.

CERTIFICATES OF INSURANCE

A variety of situations exist when a division may be asked to provide evidence that the AS and/or AS employees are insured. Divisions that are asked to provide evidence of the AS’s liability insurance should contact the Associate Director.
